First CA meeting, all eyes on court
Kathmandu, Jan 7 – Who should call the first Constituent Assembly meeting has been a matter under consideration at the Supreme Court following debate between two institutions– the president and prime minister.
The Article 51.1 of the Interim Constitution of Nepal has the provision to call the parliament meeting by president on the recommendation of the prime minister. But it has provision for first CA meeting by prime minister in Article 69.1.
In countries like India and UK, the head of state calls and ends the parliament session.
In 2008, the then Prime Minister Girija Prasad Koirala taking responsibility of head of state after CA election had called the first meeting.
The second CA election was not imagined then and it was not amended even after 12 times of amendment of interim constitution.
It is quite political, it should have been solved by consensus, but it now came to court through the street, said constitution expert Dr. Bipin Adhikari.
Although President Dr. Ram Baran Yadav has put forth views to call the CA meeting, the Council of Ministers has thought of moving ahead on the basis of constitutional provision.
Government spokesman and Minister for Information and Communications Madhav Poudel said the government has prepared to call as per the provision to call by the prime minister in the Interim Constitution.
The president is, however, making consultations on it with top leader of parties and legal experts.
