Mandamus order to immediately shut illegal excavation of river-based materials

KATHMANDU, JANUARY 20 : The Supreme Court has issued a five-point mandamus order directing the government to immediately halt the illegal excavation of river-based materials across the country. The divisional bench, comprising Justices Dr. Manoj Kumar Sharma and Tek Prasad Dhungana, emphasized taking action against individuals involved in the unlawful extraction and shutting down ongoing illegal excavation activities.
The court also directed the government to enact a dedicated "River Products and Natural Resources (Excavation and Control) Act" to safeguard rivers and their ecosystems. This legislation aims to enhance the conservation of natural resources by providing clear legal frameworks.
Additionally, the mandamus order calls for the immediate formulation and enforcement of the proposed act, in alignment with the "Work Procedure for the Collection and Use of River Products" introduced in 2075 BS and existing provincial standards for the excavation, sale, and management of stones, pebbles, and sand.
The ruling came in response to a writ petition filed at the Supreme Court, demanding an end to illegal mining activities in rivers and streams nationwide. The apex court issued the order after carefully reviewing the petition, underlining the urgency of conserving the country's natural resources.
