Case on judges’ appointment sent to constitutional bench

Kathmandu, July 12m . The Supreme Court (SC) has issued an order to send a case of dispute on the appointment of 80 judges at high courts to the Constitutional bench.
A full division of SC justices, Om Prakash Mishra, Bam Kumar Shrestha and Dambar Bahadur Shahi, today issued the order to refer the dispute related to appointment of judges at high court to the Constitutional bench citing serious constitutional complexity.
The Judicial Council had recommended the appointment of 80 judges for high courts in January 2017.
It is stated in the court ruling that the dispute needs to be sent to the Constitutional bench since the proportionality principle was not taken into consideration while appointing judges as per the Judicial Council Act.
