If the charges are proved, Sandeep Lamichhane may be jailed for 10 to 12 years
Kathmandu, sept 8. Nepali National cricket team captain Sandeep Lamichhane has been accused of raping a 17-year-old minor. A complaint has been registered against him at the police station. The police are gathering evidence against him.
The victim alleged that on August 5, at 11:55 PM, Sandeep took the minor to the airport hotel ‘Kathmandu Inn’ and repeatedly raped him. The police have requested permission to arrest Sandeep in the district court in Kathmandu. According to an officer of the police station, the arrest warrant has not yet been received.
According to clause (d) of sub-section (3) of section 219 of the Civil Code 2074, if the charge is proved, Sandeep can be sentenced to imprisonment for 10 to 12 years. Raping a woman who is sixteen years of age or above sixteen years of age and below 18 years of age can be punished with imprisonment from 10 years to 12 years.
There is a legal system in which minors under the age of 18 are punished as forced labor even if they have consented to it. The victim of Sandeep is a minor. There is a legal provision that a fine of 500,000 is imposed on minors under 18 years of age. Similarly, there is a provision to pay compensation to the victims. As the case of coercion is a criminal offense of moral turpitude, there is a strict system that will also disqualify you for government jobs in the future. The Criminal Code also provides that minors can file a complaint for 3 years from the date they reach 18 years of age.
